September First Day of Fall #WellBuds Social Media Prize Drawing
Terms and Conditions
Temescal Wellness will be hosting a prize drawing on Instagram from 9/22/2022 at 12PM EST to 9/26/2022 at 12PM EST. No purchase necessary to enter. Must be 21+ years of age and either an MA resident or able to easily travel to MA.
By entering into this prize drawing, entrants agree to be bound by these terms and conditions and confirm that all information submitted is true, accurate and complete.
1. Entrants shall at all times act in good faith towards Temescal Wellness and Dunkin’.
Who is eligible to enter this prize draw?
2. This prize drawing is open to persons aged 21 or over who have a valid license and are able to travel to MA.
3. Entrants must have internet access to an Instagram or Facebook account and are bound to the social media platforms’ terms of use in order to enter the prize drawing.
4. Employees or their immediate family of Temescal Wellness, Dunkin’ or Kel & Partners or any of their associated companies, subsidiaries, affiliates or suppliers are excluded from entering the prize drawing.
5. No purchase or payment is required.
When can I enter?
6. The prize draw is open from 9/22/2022 at 12PM EST to 9/26/2022 at 12PM EST. Entries received after the promotion period will not be entered into the prize drawing.
How do I enter?
7. Entrants can enter the prize drawing via Temescal Wellness’ Instagram feed post
To enter on Instagram:
7a. Follow @temescalwellness.ma
7b. Answer the prompt.
7c. Tag 1 friend in the comments.
7d. Entrants need to be following @temescalwellness.ma at 12PM on 9/26/2022 in order to be entered to win.
8. Multiple entries per person are allowed (up to 5 entries with different IG handles tagged) however the same person is not permitted to win both prizes.
9. Temescal Wellness reserves the right to disqualify any and all entrants who do not comply with these entry requirements, or entries which contain any third-party intellectual property without prior informed consent from the rights holder, or which contain any abusive, inappropriate, offensive or obscene language or imagery. Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to): any message/image which contains (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) sexual innuendo, sexual language or sexual acts, actions or gestures; (d) promoting any illegal unlawful activity; (e) any message that appears to be an advertisement or solicitation to buy; and (f) any materials (whether written or visual) that directly or indirectly relate to Temescal’s competitor brands or that show any intention of promoting any brand other than Temescal Wellness.
What are the prizes?
10. Prizes: Dunkin’ Gift Cards valued at $75 and $25.
11. There is no cash alternative available. No transfer or assignment of prizes will be permitted. Temescal Wellness reserves the right to substitute prizes of equal or greater value.
How will the winners be selected?
12. There will be two (2) winners selected from entries made via the entry methods.

How will the winners be notified and receive the prize?
14. Temescal Wellness will verify entrant eligibility and notify the potential winners via a tagged reply to their comment after the promotion period has ended on 9/26/2022 at 12PM EST.
15. The winners must reply to the notification within 1 day from the notification date, in order to confirm prize retrieval.
15a. If no response is obtained within 1 day from the notification date, the prize will be forfeited and may be awarded to an alternate winner selected in a random draw from the remaining eligible entries. Again, the prize draw winner must reply to the notification within 1 days from the notification date to claim the prize. There will be 3 alternate drawing(s) after which the prize will remain unawarded. The unclaimed prize will not be awarded.
16. The winners will have to visit the dispensary of their choice to obtain the prize. The winners must physically visit the store to be dispensed their prize.
16a. Locations include 665 Cochituate Road, Suite B Framingham, MA, 252 Coolidge Street Hudson, MA, and 10 Callahan Drive Pittsfield, MA.
Use of your personal information for this prize drawing:
17. Temescal Wellness is the controller for the processing of personal data in connection with the promotion.
18. Temescal Wellness will use your Instagram handle you provide for the promotion for purpose and duration of the promotion. Temescal Wellness will use this information for the sole purpose of contacting you, should you win the promotion.
Liability
19. Temescal Wellness is not responsible for late, lost, misdirected, mechanically reproduced, mis-delivered, incomplete, illegible, or unintelligible entries, messages or posts; unavailable network connections; failed, incomplete, garbled, or delayed computer transmission; online failures; hardware software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the prize draw in any manner.
20. Temescal Wellness reserves the right to re-distribute, re-share and store content onto their social platforms.
21. Temescal Wellness is not responsible for any inaccuracy in the contact details supplied by the participant that may result in the inability to contact that participant.
22. Temescal Wellness reserves the right to disqualify an entrant or winners that, in its absolute discretion, could bring Temescal Wellness or Dunkin’ into disrepute.
23. Temescal Wellness shall disqualify any entries that have failed to abide by and/or are in breach of these terms and conditions.
24. By entering the prize draw, entrants will be deemed to be bound by and have accepted Instagram Terms, Instagram Privacy Policy and Instagram API Terms. Temescal Wellness reserves the right to disqualify any entries that have failed to abide by and/or are in breach of these aforementioned terms.
25. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook. You are providing your information to Temescal Wellness and not to Instagram or Facebook. The information you provide will only be used as stated in these terms and conditions. By entering the prize draw, entrants will be deemed to have released Instagram from any and all liability arising from their participation in the prize draw or out of, pursuant to, or as a result of the carrying out of the prize draw.
26. Temescal Wellness’ decision is final, and no correspondence will be entered into.
27. Temescal Wellness reserves the right in its absolute discretion to amend or waive any of these Terms and Conditions, or suspend or cancel the prize drawing at any stage, in the event of circumstances that are unforeseen or beyond its reasonable control (including suspected or actual fraudulent or misleading practices or other breaches of these Terms and Conditions).
What laws apply to this free prize draw?
28. This prize draw is governed by the laws of the United States of America.
